Escalation is a commercial decision informed by legal assessment. It is not an automatic consequence of non-payment, and it is not taken without your authority.
Merits and evidence
Whether the claim is supported by the documents, and what the debtor is likely to say in response.
Route selection
Court proceedings and insolvency processes serve different purposes. Insolvency routes are not appropriate where a debt is genuinely disputed on substantial grounds.
Cost and recoverability
Court fees, disbursements and the realistic prospect of recovering both the debt and the costs of pursuing it.
Common questions
- Do you issue proceedings automatically if the debtor does not pay?
- No. Proceedings are only considered where they are appropriate, proportionate and authorised by you following an assessment of the merits and recoverability.
